I – General Conditions

Please read our terms and conditions for a better consultation of our site.

These terms and conditions can be altered by arteportugal at any moment. Please be sure to read them in advance since the use of this website constitutes your acceptance of the terms and conditions set out herein.

II – Copyright

1. All the content of this site is protected by Copyright and Related Rights, as well as Rights of Industrial Property under the Portuguese and European Union law, international conventions and other laws. It cannot be used outside the conditions admitted in this site and without arteportugal’s consent. 

2. All the texts, images, illustrations, works, photographs, advertising, logos and other elements displayed on this site are protected by law and any copy, reproduction, broadcast or transmission, use, modification, sale, publication, distribution or any other use, in whole or part, commercial or non-commercial, is expressly interdicted and prohibited, whichever the means used for this purpose. 

3. The exceptions to the previously mentioned interdiction are the free uses authorised by law, namely the right to quote, as long as the origin is clearly identified.

4. The user may unload or copy material for personal use, with arteportugal having the ownership of the respective copyright. 

5. The use of this site for illegal purposes or any other purposes which can be considered harmful to the image of arteportugal has in the market.

III – Liability

1. arteportugal is not responsible for any direct, indirect and/or accidental damages arising from the use or inability to use the materials contained in this site.

2. arteportugal does not control and is not responsible for any illegal, offensive or derogatory conduct on the part of its users.

3. arteportugal does not guarantee compatibility of the contents of this website with all computer systems and browsers.

4. arteportugal allows a connection to other internet sites, owned by third parties, making it clear that it does not control or operate the information, products or services of these sites and therefore shall not be held responsible for them.

5. arteportugal shall not be subject to complaints, penalties, damages or expenses arising from the use or inability to use this website and also arising from changes to this same website.

6. The electronic publications of this site are subject to Portuguese law, insofar as it is applicable to them, namely for the purpose of responsibility for facts, opinions, articles and comments from people/artists or duly identified bodies.

IV – Privacy Policy

1. arteportugal will not automatically gather any type  of  personal information from its users, who will remain anonymous during their visit to the site.

2.  However, arteportugal may gather information of a non-personal nature and destined to optimise navigation in this site. 

3. The personal information supplied voluntarily by the user when purchasing products or filling the site’s questionnaires is for the exclusive use of arteportugal and will not be divulged to third parties, without the owner’s previous consent.

4. The user has the right to access his/her personal information, rectify it if not correct or even delete it, by sending an email message and whenever properly identified.

V - Delivery and Return of Goods

The works acquired are sent directly to the purchaser by a certified transport company which makes a door to door delivery within 15 (fifteen) working days.

If the delivery of an artwork is delayed, for reasons not imputable to arteportugal and/or the transporter contracted for this purpose, arteportugal will not be held responsible for any damages allegedly suffered by the client.

If the delivery of an artwork is delayed for reasons imputable to arteportugal and/or the transporter contracted for this purpose, arteportugal will assume responsibility for both the shipping costs and the return of the goods.

Artworks can be returned within a period of fourteen (14) days from the date of reception.

Returned works will only be accepted within the time period defined in the above paragraph and on condition that the work has been returned in the same condition that it was delivered and has not been damaged in any way.

Shipping costs will not be reimbursed.

V – Applicable Law and Jurisdiction

1. The conditions of use will be applied in accordance with the Portuguese law.

2.  The Portuguese courts shall have exclusive jurisdiction to settle any claim, dispute or other questions which may arise from the interpretation of the present conditions of use.
